Why now
The rules already have dates.
December 2026
Ley 21.719, Chile
Chile updates its personal data protection law, published on 13 December 2024: automated decisions, the right to an explanation, and portability. It applies from December 2026, unless the pending postponement passes. An agent that decides about a worker or a contractor will have to prove what it did and why.
2010
Ley 20.417, Chile
The 2010 law that created the Environment Superintendency (Superintendencia del Medio Ambiente), which enforces compliance with each project’s environmental approval (resolución de calificación ambiental, RCA), emission standards and plans, and imposes sanctions.
2019
Resolución Exenta 1.574, Chile
The Environment Superintendency’s general instruction on the online connection of continuous emission monitoring systems (CEMS), published in November 2019: whoever must have a CEMS must connect it online to the Environment Superintendency and transmit in real time.
2016
Decreto Supremo 024-2016-EM, Peru
Mining Occupational Health and Safety Regulation (Reglamento de Seguridad y Salud Ocupacional en Minería), in force since July 2016: up-to-date records of incidents and accidents, hazard identification and risk assessment and control (IPERC), and written high-risk work permits (PETAR) signed each shift. It also applies to contractors.
2025
Ley 29733 y su Reglamento, Peru
The Regulation of the Personal Data Protection Law (Decreto Supremo 016-2024-JUS), in force since March 2025: disclose that automated decisions and profiling exist, notify serious incidents to the authority within 48 hours, and keep activity records for at least two years.
2009
Ley 29338, Peru
Water Resources Law (Ley de Recursos Hídricos), of 2009: mining use of water requires a use right; holders install and maintain metering devices, and users of groundwater report its levels every month.
Dates are projections of the current development plan, not commitments.
